Checklist for producers and processors

The Bio-Siegel may only be used to label organic food if the following prerequisites are met:

1 The company participates in the control system under Regulation (EU) 2018/848

Every company that cultivates, produces, processes, prepares, stores or markets organic products is subject to inspections according to EU legal provisions on organic production.

2 The product was produced and certified according to EU legal provision on organic production

Organic products which were produced, processed or imported in accordance with EU legal provisions [Regulation (EU) 2018/848 and implementing rules] may be labelled with the Bio-Siegel.

Principally, all ingredients of agricultural origin must stem from organic farming. Strict exceptional rules are provided for up to five percent of ingredients: they  must be listed in Annex V Part B of Regulation (EU) 2021/1165, or a duly substantiated exception must have been granted by the competent authority.

3 The Bio-Siegel meets the graphical requirements of the German Eco Label Ordinance

The Bio-Siegel may be used on packaging, advertising and promotional materials only in accordance with the German Eco Label Ordinance. The design guide provides information on the design and use (size, placement on the packaging, etc.) of the Bio-Siegel.

The Bio-Siegel is registered as a protected trademark with the German Patent and Trademark Office. Any claims as to rights of prohibtion or damages which might result under private law shall be pursued by the Federal Ministry of Food and Agriculture (BMEL) as the proprietor of the trademark.

4 You have notified the product to the Bio-Siegel Information Service

Prior to placing a product labelled with the Bio-Siegel on the market for the firsdt time you must notify it to the Bio-Siegel Information Service. There are various options to to so.

5 You sent a sample label to the Bio-Siegel Information Service?

For each notification (in the Bio-Siegel database, via e-mail, telecopy or surface mail), the sample labels for the registered products shall be sent to the Federal Office for Agriculture and Food (BLE).

This can either be done directly within the Bio-Siegel database, via pdf-file for each product notified, or by e-mailing a pdf-file, or by sending sample labels by telefax or – attached to a DIN-A4 sheet – by surface mail.

Access to the Database

Pending the submission of your complete documents, i.e. the activation of your entry, you shall receive an e-mail with your data from the Bio-Siegel database.

As soon as you have created an account with your own password, you will be able to update your entries or to add further products to your list of products. For reasons of data protection only data of companies are published that have agreed to such publication when they notified their labelled products.

The unlawful use of the Bio-Siegel is an administrative offence subject to respective fines.

Entries made in the course of product notification can be made available to the "Länder" authorities responsible for the monitoring of organic farming for inspection purposes.

Please also note:

Products which have unlawfully been labelled with the Bio-Siegel can be withdrrawn from the market. In addition and in case of administrative offences, the German Eco Label Law prvides for administrative fines of up to thirty thousand euros.
